An analysis of the transparency of judicial institutions points to certain systemic deficiencies that need to be addressed in order to improve communication of the judiciary with the public. A review of the web pages of courts and prosecutor’s offices in BiH shows that the rules on the publication of indictments and judgments are not consistently applied.
This paper focuses on the issue of transparency of judicial institutions, with a focus on prosecuting corruption in Bosnia and Herzegovina today. The focus on corruption is justified by the particular importance that the judiciary has in the fight against corruption and by the particular interest in these cases on the part of the public. The author analyzes the proactive and reactive dimensions of transparency of courts and prosecutor’s offices in BiH. The main question in this sense is how much news, press releases, indictments, and judgments can be found on the websites of these institutions, as well as the question of the quality of work of the judiciary in responding to inquiries by citizens and journalists regarding the processing of corruption-related criminal offences. The conclusion points to significant problems in the context of both dimensions of transparency of the judiciary in BiH, and sketches framework recommendations for addressing those problems.
