
Analitika’s new Policy Memo aims to highlight the key shortcomings that should be remedied in the context of the upcoming activities related to the amendments to the Law on Prevention of Discrimination and offers a series of recommendations on how this could be done. All recommendations were formulated primarily from the perspective of what was in the best interest of the victims of discrimination and how to stimulate the effective use of mechanisms of judicial protection and protection of the Institution of Human Rights Ombudsman of Bosnia and Herzegovina.
Although a comprehensive legal framework for protection against discrimination in BiH, which was adopted in 2009, brought almost all key innovations of specific civil proceedings for protection against discrimination stipulated by European Anti-Discrimination law, there is still only a small number of victims who decide to seek judicial protection or turn to the Institution of Human Rights Ombudsman of Bosnia and Herzegovina. Such a situation is caused by a range of factors, among which an important one is the legal framework, with certain solutions which are not in the best interest of the victims of discrimination.
