Expert Discussion on Transparency in Public Procurement in Bosnia and Herzegovina

Center for Social Research Analitika organized expert discussion in Brčko titled "Transparency in Public Procurement in Bosnia and Herzegovina: The scope and limitations of the new legal framework" with the aim to encourage discussion on the extent to which the new legal framework provides an adequate level of transparency in public procurement in BiH, and how transparency could be improved.

The principle of transparency is one of the key principles of a just and functional public procurement system and includes accessibility of all the relevant information which enable the interested parties to familiarize themselves with the rules and procedures used in the public procurement process. The BiH Law on Public Procurement, which has been applied since November 2014, prescribes a number of new legal provisions that should contribute to improving transparency, as one of the key principles of the public procurement system.

Nevertheless, the participants of expert discussion pointed to the need for further improvement of transparency of the public procurement system, with the focus on greater access to information on planned public procurement, implementation of public procurement for low-value contracts, the criteria for evaluation of bids and implementation of public procurement contracts. In this context, transparent implementation of public procurement should contribute to better accountability of public authorities, more effective control of public spending and strengthen the trust of both the business sector and the public in the public procurement system.

Expert discussion gathered key stakeholders in the field of public procurement, primarily representatives of public institutions, employers' associations and chambers of commerce in BiH , as well as NGOs dealing with the monitoring of public procurement in BiH.

The expert discussion is organised within the project "Open Public Procurement in Bosnia and Herzegovina", funded by the European Union, and co-funded by the UK Government. The project is implemented by the Center for Investigative Reporting (CIN) , Center for Social Research Analitika, and Public Interest Advocacy Center (CPI).
